Subclass 820 and 801 partner visas permit spouses and partners of Australian citizens, permanent residents, and qualified New Zealand citizens to remain in Australia.
Your ability to remain in Australia throughout the processing of your permanent partner visa (subclass 801) is contingent upon the approval of your temporary partner visa (subclass 820).
Eligibility
To qualify, you need to be married to or living with:
- an Australian citizen
- A permanent resident of Australia
- An eligible New Zealand citizen.
The Australian government recognizes only legally legitimate marriages. Meaning, if you’re 16 or 17 years old, you’ll need your parents’ OK.
You need to have a minimum of one year of experience in a de facto a relationship.
Length of stay
- You are allowed to remain on the temporary 820 visa until your permanent Partner visa (subclass 801) is decided.
- You may remain in the country indefinitely with a permanent 801 visa.

Before your Prospective Marriage visa (subclass 300) expires, you should marry your fiancé and apply for a Partner (subclasses 820 and 801) visa if this visa is granted to you.
Eligibility
You must:
- want to tie the knot
- know each other and have met your future spouse
- (Same-sex couples may apply for a Partner visa) Be the opposite sex to your future spouse nevertheless.
- Must be 18 or older.
