Priority Australian workers
In a chaotic move for 457 visa holders, Prime Minister Malcolm Turnbull put a bid in to give more jobs to Australians. “Australian workers must have priority for Australian jobs. We will no longer allow 457 visas to be passports to jobs that could and should go to Australians. The new visa will better target genuine skills shortages across the country especially regional Australia.” Said Malcolm Turnbull.

Now a series of information sessions are being organised by official from the Department of Home Affairs and will be held in major cities throughout Australia.
Temporary Skill Shortage visa (TSS) and SOL lists
The Skilled Occupation List (also referred to as the SOL is a list of skilled occupations such as Engineers, Midwives etc.) targets migrants within these professions that are needed to fill jobs in Australia in order to grow the economy.
Nominate an occupation
For skilled migrants, they must nominate an occupation that appears on the list that they are qualified for and have a recent work history of, to accrue points to be eligible for skilled migration to Australia.
Each year, the Skilled Occupation List is assessed and jobs are either added or taken off depending on the needs of the country as well as being state and region specific.
Temporary Skill Shortage Visa
Under the new Temporary Skill Shortage (TSS) visa which as of March 2018 has replaced the 457 visa program skilled migrants will still be able to come to Australia to fill jobs on the SOL, but will allow for fewer eligible skilled occupations than the previous 457 visa.
Short-Term and Medium-term visa
The Short-Term stream of the Temporary Skill Shortage visa will allow a qualifying individual to stay in Australia for up to two years. It is worth noting you can only re-apply for this type once. Whereas the Medium-Term stream of the TSS will allow a stay for up to four years. This type of visa can be renewed onshore and holders of this visa may apply for Permanent Residency after three years of working and living in Australia.
What this means
This means that the occupations listed will be separated into the Short Term Skilled Occupations List (STSOL) and the Medium Term Skilled Occupations List (MTSOL) respectively. There will also be the Long-term Strategic Skills Occupation List; however should you need clarity on the new set-up it is advisable to speak to a registered migration agent.
Law from March 2018
From March 2018 the new occupations list for the TSS visa as well as the Employer Nomination Scheme (ENS) 187 visa and Regional Sponsored Migration Scheme (RMSM) 187 visa will all be published.
The new framework of visas have tighter, more strict requirements and include having a higher English language proficiency. They also require more work experience as well as additional character and anti discrimination and training requirements, as well as salary rates in line with current Australian wage.
Local market testing
In line with Prime Minister Malcolm Turnbull’s bid to give more Australians jobs businesses prepared to sponsor migrant workers will also be required to test the local market first before taking on a migrant worker.
