Jobactive Labour Market Testing (LMT) Requirement before nominating an overseas skilled worker on a Subclass 457 / 482 TSS Visa or a Subclass 494 Skilled Employer-Sponsored Regional (Provisional) Visa.
Change
Currently, employers must make two national advertisements to test skills availability in the local market. The change will mean employers must also advertise the role on the Government’s Jobactive website.
Visa sponsors will soon need to meet an additional Labour Market Testing (LMT) Nominations
The amendment to the Legislative Instrument commences tomorrow, (3rd September) and this new LMT requirement will begin to apply to all nominations made after 30 September 2020.
Priority Occupations Announced for Employer-Sponsored Visas
Employers should also note that Acting Minister for Immigration, Alan Tudge has announced a new Priority Migration Skilled Occupation List (PMSOL), which will give priority processing for Employer-Sponsored Visa applicants under 17 occupations.
The below occupations in the Health Care, Construction and IT sectors have been listed under the PMSOL in an effort to boost Australia’s COVID-19 recovery:
- Chief Executive or Managing Director
- Construction Project Manager
- Mechanical Engineer
- General Practitioner
- Resident Medical Officer
- Psychiatrist
- Medical Practitioner nec
- Midwife
- Registered Nurse
- Registered Nurse (Critical Care and Emergency)
- Registered Nurse (Medical)
- Registered Nurse (Mental Health)
- Registered Nurse (Perioperative)
- Registered Nurses nec
- Developer Programmer
- Software Engineer
- Maintenance Planner
Sponsoring Visa Holders
Australian businesses can sponsor suitably skilled and experienced visa holders under the above PMSOL occupations. Labour Market Testing (LMT) is required as part of the sponsorship process.
Travel Exemption
Sponsored visa holders can request a Travel Exemption to enter Australia.
Existing List Active
Existing Skilled Migration Occupation Lists remain active and visas are still being processed under standard employer-sponsored Skilled Visas. However, the Government will prioritise visa processing for applicants with occupations on the PMSOL.
Skilled Migration Occupation List
In our experience, visas are generally being granted to applicants on existing Skilled Migration Occupation Lists if they can obtain a Travel Exemption to enter Australia – such as for Critical Work. All visa holders are required to meet a strict 14 day quarantine on arrival.
Reviewed Regularly
The Priority Skills List will be reviewed regularly and updated according to Australia’s health and economic COVID-19 recovery and changes in the labour market.
